Ensuring Compliance with
Our Governing Documents

The purpose of this article is to explain the Covenants Com-
mittee’s role and procedures in ensuring compliance with our
governing documents. Since Sun City Texas is a covenants
community and one of the reasons why many of us bought
homes here, the Community Association must enforce our
covenants or we could lose them. Fortunately, considering
our population, incidents are relatively few and are corrected
rather expeditiously.

Our governing documents assign responsibility for ensuring
compliance to the Board of Directors and the Covenants Com-
mittee. The Covenants Committee is comprised of five resident
volunteers who are appointed by the Board of Directors to
serve two-year terms. Staff responsibility is handled by the
Community Standards and IT Director, Carl Zimmerman.
Most allegations of non-compliance are investigated by the
Community Standards Department and result in an acceptable
solution to bring the matter into compliance. Those allegations
that are not resolved are referred to the Covenants Committee.
Referrals include information concerning the background of
the situation, the actions taken by the Community Standards
Department and the results. Occasionally, residents bring al-
legations directly to Committee members; such cases may be
referred to the Community Standards Department or handled
similarly to cases that have been referred to the Committee.
The Committee regularly meets on the first Wednesday of each
month. Special meetings are held, if necessary. Agendas are
posted on the Sun City Texas website. All case discussions
are conducted in Executive Session, in conformance with the
confidentiality provisions of our governing documents. Pro-
cedures followed by the Committee depend on the situation
and facts related to each case. The Committee has no “cookie
cutter” set of procedures.
Case work
Generally, the Committee analyzes the information received,
conducts its own investigation, and determines the appropri-
ate action required to correct the situation. In most cases,
residents involved are invited by an official letter to meet
with the Committee at its next monthly meeting. After the
interview, the Committee decides if further investigation is
necessary and what action is appropriate.
The Committee’s focus is to correct any improper conduct and
to encourage residents henceforth, to conduct themselves in
accordance with our governing documents. Although autho-
rized to levy fines and to issue sanctions, such as voiding an
individual’s right to use CA facilities, usually such action is
limited only to the most severe or repeat cases.
The Committee communicates its decisions to the individuals
involved by certified mail. Individuals are informed that they
may appeal the Committee’s actions to the Board of Directors,
whose decisions are final. The Community Standards Director
ensures appropriate actions by the CA staff are accomplished.
The Committee monitors each case until all required actions
are completed.
The Covenants Committee hopes, through this article, that
residents will have a better understanding of the responsibili-
ties and actions by the Committee, and will feel confident that
enforcement of our governing documents is being accomplished
in a positive and fair manner.
HOLIDAY DECORATIONS
For a period beginning one week prior to, the day of, and
for one week after a holiday, decorations appropriate to
the holiday may be displayed. Since Easter is April 20
this year, you may keep your decorations up from April
13 through April 27.
Exterior Paint
We in Community Standards know it is spring when resi-
dents begin calling with questions about painting their
homes. For those who like the colors they picked initially,
no paperwork is required to update the existing paint with
a new coat—but, perhaps you have seen a neighboring
house with colors you prefer. Bring to our office a picture
of the house you like, with its address, and we’ll be happy
to help you look through the book of samples to try to find
it. The colors that have been used over the years by the
Developer can be found online under Exterior House Paint
Schema (under “E” in the Site index), where most people
narrow down the choices prior to a final decision. Due to
irregularities in monitor and printer display of colors, it
is a good idea to come to the Community Standards Of-
fice (in the Billiards Center) and take a look at our paint
samples—and even pick that perfect color once you have
it narrowed down to two or three choices.
Parking
As many residents probably know, there is no overnight
parking on the streets in Sun City Texas neighborhoods.
If parking in the garage or driveway is not an option,
please go to the Monitor’s Desk nearest your residence
and obtain a parking permit for one of the locations where
parking of a car is allowed overnight. Monitors will be
glad to issue a permit for a few days, but the long-term
answer is to have all vehicles in the garage and/or the
driveway. Also, be aware that during this time of year,
more residents are walking in the evening in areas where
there may not be sidewalks. Be safe!
