A MESSAGE FROM THE POLICE DEPARTMENT
Responsibilities of Vehicles & Pedestrians at Crosswalks
Submitted by Officer David Scurlock, Georgetown Police Department, Traffic Division

The City has increased the visibility of several crosswalks with markings and additional signage to alert and remind drivers to watch for and yield to pedestrians. These have been in place for some time but complaints are still being made. Some residents do not fully understand the law when it comes to the responsibilities of vehicles and pedestrians at crosswalks.

The Texas Transportation Code governs these responsibilities and the law that most applies to crosswalks in Sun City is Sec. 552.003:

Pedestrian Right-of-Way at Crosswalk
(a) The operator of a vehicle shall yield the right-of-way to a pedestrian crossing a roadway in a crosswalk if:
(1) no traffic control signal is in place or in operation; and
(2) the pedestrian is:
(A) on the half of the roadway in which the vehicle is traveling; or
(B) approaching so closely from the opposite half of the roadway as to be in
danger.

(b) Notwithstanding Subsection (a), a pedestrian may not suddenly leave a curb or other place of safety and proceed into a crosswalk in the path of a vehicle so close that it is impossible for the vehicle operator to yield.

(c) The operator of a vehicle approaching from the rear of a vehicle that is stopped at a crosswalk to permit a pedestrian to cross a roadway may not pass the stopped vehicle.

The crosswalk at Whispering Wind and Del Webb Blvd would be an exception to this statute since it is a controlled intersection with pedestrian crossing signals. In controlled intersections, pedestrians are prohibited from crossing without having a “WALK” signal and may not cross an intersection when cross traffic has a green light. (Sec. 552.002. PEDESTRIAN RIGHT-OF-WAY IF CONTROL SIGNAL PRESENT).
There are also many pedestrians that cross in the middle of the block or in areas without crosswalks. In these situations, the pedestrian is required to yield to all vehicles and has no right of way while crossing. (Sec. 552.005. CROSSING AT POINT OTHER THAN CROSSWALK).

Pedestrians are Required to Use the Sidewalk
Another safety concern for pedestrians is walking on the roadway. While sidewalks are not found everywhere in the City, when available, pedestrians are required to use the sidewalk and not be in the roadway. (552.006. USE OF SIDEWALK).
Be vigilant, be safe.
